Welcome to Tennis Fans Club (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of https://www.tennisfansclub.com/
(the “Site”), our giveaway funnels, contests, promotions, and any related services, apps, or widgets (collectively, the “Services”). By accessing or using the Services you agree to these Terms. If you do not agree, do not use the Services.

2. Acceptance of terms
By using the Services you represent that you are at least 13 years old (or older where local law requires), that you can form a binding contract, and that you agree to comply with these Terms and any policies referenced herein (including our Privacy Policy and Giveaway Rules). Minors may not participate in certain promotions — check the specific rules for each promotion.
3. Changes to Terms
We may modify these Terms at any time. If changes are material, we will provide notice (for example, via the Site, email, or prominent notice). Continued use of the Services after the effective date of the revised Terms constitutes acceptance of the changes.
4. Additional rules for giveaways, contests and promotions
a. Separate official rules will apply to each giveaway, contest, sweepstakes, or promotion. Those official rules (including eligibility, entry methods, prize details, deadlines, and how winners are selected) are part of these Terms.
b. No purchase is necessary to enter or win unless explicitly stated. Follow the official rules for each promotion.
c. Winners are responsible for any taxes, fees, or other costs associated with accepting prizes.
d. We may require verification of eligibility and identity before awarding a prize. Failure to timely provide requested information may result in forfeiture.
5. Accounts, registrations, and security
If you create an account, you agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity under your account. Notify us immediately of unauthorized account use.
6. User content and license
a. “User Content” means any information, photos, videos, messages, comments, or other content you submit to the Services.
b. By submitting User Content you grant Tennis Fans Club a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, use, copy, modify, distribute, publish, and display that content for the purpose of operating, promoting, and improving the Services and running promotions (including for marketing and advertising).
c. You represent and warrant that you own or have the necessary rights to submit User Content and to grant the license above, and that User Content does not violate the privacy, publicity, intellectual property, or other rights of any third party.
d. We may remove or refuse to publish User Content for any reason, including content that violates these Terms.
7. Prohibited conduct
You agree not to:
• Use the Services in violation of law or third-party rights.
• Provide false information or impersonate others.
• Interfere with or disrupt the Services, or attempt to circumvent security.
• Use bots, scrapers, or automated means to access or collect data from the Services without our permission.
• Promote illegal activity or distribute malware.
• Harass, threaten, or defame other users.
We may suspend or terminate accounts and access for violation of these rules.
8. Intellectual property
All content of the Site and Services (design, text, images, logos, code, graphics, and software) is our property or licensed to us and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, create derivative works from, publicly display, or otherwise use our content except as expressly permitted by us in writing.
9. Links to third-party sites; third-party brands
The Services may link to or mention third-party websites, goods, and brands (including Head, Wilson, and Babolat). We do not control those third parties and are not responsible for their content, practices, or terms. Any relationship with brand partners is governed by separate agreements. Your use of third-party sites is at your own risk.
10. Payments, purchases, subscriptions (if applicable)
If the Services include paid products, digital goods, or subscriptions:
• You agree to pay all fees and taxes in connection with those purchases.
• Paid content is non-refundable unless otherwise stated.
• We may change prices; changes do not affect orders already placed.
• You authorize us to charge the payment method you provide.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THAT THE SERVICES MEET YOUR NEEDS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TENNIS FANS CLUB (OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR PARTNERS) BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED $100 USD (OR THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW).
13. Indemnification
You agree to indemnify, defend, and hold harmless Tennis Fans Club and its officers, directors, employees, agents, and partners from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your breach of these Terms, (b) your User Content, or (c) your violation of any law or the rights of a third party.
14. Privacy and data
Our collection and use of personal information are governed by our Privacy Policy. By using the Services you consent to the collection, use, and disclosure described in the Privacy Policy.
15. Termination
We may suspend or terminate your access at any time for any reason, including if you breach these Terms or for operational reasons. Upon termination, your right to use the Services stops immediately. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
16. Notices
We may provide notices by email, posting on the Site, or by other reasonable means. You agree that notices to the contact email you provide are effective.
17. Governing law; dispute resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. For disputes not subject to mandatory arbitration (if any), you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas.
Optional Arbitration Clause (delete if you prefer court resolution): Except for small claims court matters or statutory claims that cannot be waived by law, you and Tennis Fans Club agree that any dispute arising from or relating to these Terms will be resolved by binding arbitration administered by the American Arbitration Association under its rules, and judgment on the award may be entered in any court having jurisdiction. The arbitration will take place in Travis County, Texas unless otherwise agreed.
18. International users
The Services are intended for users located in the United States. If you access the Services from other jurisdictions, you are responsible for compliance with local laws. We make no representation that the Services comply with laws outside the U.S.
19. Refund policy
Unless stated otherwise for a specific product or promotion, we do not offer refunds for digital downloads, entry fees, or promotional entries. For purchases of physical goods, refer to the product’s return policy or contact [email protected]
for assistance.
20. Promotional partners and sponsors
When we run promotions that involve third‑party sponsors or partners (including Head, Wilson, and Babolat), the sponsor’s rules and terms may also apply. You agree that we are not responsible for the products, services, or prize fulfillment of third-party sponsors.
21. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.
22. Entire agreement
These Terms (including any documents incorporated by reference, such as the Privacy Policy and Giveaway Rules) constitute the entire agreement between you and Tennis Fans Club regarding the Services and supersede all prior agreements.
